Terms of Service

These Terms are an agreement between you and SCENE LABS INC ("SCENE", "we", "us"). They cover your use of the SCENE app, the website at datethescene.com and any related services (together, the "Service"). By applying to join or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

Please read section 17. It requires most disputes to be resolved by individual arbitration and waives class actions.

1. Who can join

  • You must be at least 18 years old.
  • You must be single, or otherwise free to use a dating service.
  • You must not have been convicted of a felony, a sex offence or any crime involving violence, and must not be required to register as a sex offender.
  • You must not have been removed from SCENE before, unless we have allowed you back.
  • You may hold only one account, and it must be in your own name with your own photos.

2. Applying and membership

SCENE is members-only. Applying is free, but approval is not guaranteed. Every application is reviewed by hand against our photo standards and community standards. We can decline, hold or approve any application at our discretion, without giving a reason. A held application may be approved later when there is room.

We may offer some members free or discounted membership, for example a guest list membership or a founding period. These offers are personal, can't be transferred and are described to you when you're approved.

3. Verification

As part of applying, we ask for a selfie, which a member of our team compares by eye with your profile photos to confirm they are of you. The selfie is never shown to other members. How we handle it is explained in our Privacy Policy. We don't conduct criminal background checks, and verification does not mean we vouch for anyone.

4. Subscriptions, auto-renewal and free periods

  • Auto-renewal. Paid membership is a monthly subscription. It renews automatically each month, and we charge your payment method at the start of each period, until you cancel.
  • Price. The price and what each tier includes are shown before you pay. We'll give you at least 30 days' notice of a price change, and you can cancel before it applies.
  • Free periods. If your membership starts with a free period, no payment details are required when you join. Adding payment details is optional until you choose a paid subscription. Your free membership will not automatically become a paid subscription, and you will not be charged unless you choose one and agree to its price and billing terms. Any free-period end date is shown when you are approved.
  • Taxes. Prices may not include applicable taxes, which we'll show at checkout.

5. Cancellation and refunds

You can cancel at any time in your account settings or by emailing hello@datethescene.com. Your membership stays active until the end of the period you've paid for, and you won't be charged again. Payments are non-refundable, including for partial months, except where the law requires otherwise. If you subscribed through the App Store, you cancel and request refunds through Apple, under Apple's terms. Full details are in our Cancellation and Refund Policy.

6. Diamonds and other purchases

Diamonds are one-off purchases that let you stand out to another member. A Diamond buys attention only: it does not affect anyone's position on The List or guarantee a match or reply. Diamonds have no cash value, can't be transferred and are non-refundable once sent, except where the law requires otherwise.

7. The List and public features

The List is a public ranking of SCENE members, visible to members and to anyone visiting our website. Positions move based on likes from other members. Separately, we may feature members on our public pages and on SCENE's Instagram, including tagging your Instagram account.

You control both with one setting, "Feature me on SCENE's public pages and Instagram". It is on by default when you join, and you can turn it off at any time in settings. When it's off, you won't appear on The List or in new SCENE posts. Content already published on Instagram may take time to remove, and copies others have made are outside our control.

When shown publicly, we may display your profile photo, first name, occupation and position on The List. We never publicly show your messages, who you've liked or who you've matched with.

If we want to use your image in paid advertising or on a billboard, we'll ask you directly first and get your separate written agreement.

8. Your content and the licence you give us

You own the photos and text you add ("your content"). You give SCENE a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, adapt (for example resizing, cropping or applying a visual treatment that doesn't alter how you look) and distribute your content to operate and promote the Service, including on The List and Instagram as described in section 7. This licence ends when you delete your content or account, except for copies already shared publicly, kept in backups for a limited time or kept where the law requires.

You confirm you have the rights to everything you upload and that the photos are of you.

9. Photo and community standards

Profile photos must be real, recent, clothed and of you. We may remove photos or decline profiles that don't meet our standards. Using SCENE, you must not:

  • harass, threaten, stalk or abuse anyone
  • impersonate anyone or misrepresent your identity, age or relationship status
  • share anyone's messages, photos or personal details outside SCENE without their consent, or try to identify where they live or work
  • send sexually explicit content, or any content involving minors
  • solicit money, promote businesses or services, or offer or request paid companionship
  • use bots, scrapers or automated tools, or try to access other accounts or our systems
  • use SCENE for anything illegal

10. Your safety

You're responsible for your interactions with other members, online and in person. We don't run background checks and can't guarantee anyone's identity, intentions or conduct. Meet in public, tell a friend where you're going, and never send money to someone you've met on SCENE. You can block and report members in the app, and we review every report.

11. Founding Partners and referral links

Some people share personal invitation links to SCENE and may be paid a commission on memberships from people they refer. Founding Partners are required to make clear when they are paid to promote SCENE. A referral never guarantees approval.

12. Casting opportunities

SCENE may develop media projects, including a television series, featuring members. Taking part is entirely optional. We will never feature you in a show without your express opt-in and a separate written agreement.

13. Suspension and removal

We can suspend or remove your account, or remove content, if we believe you've broken these Terms, put others at risk or harmed SCENE, or if we're required to by law. If we remove your account for breaking these Terms, we won't charge you again, and you won't receive a refund for the current period. You can delete your account at any time in settings.

14. Changes to the Service and these Terms

We may change, add or remove features. We may update these Terms; if a change is material, we'll notify you in the app or by email before it takes effect. Continuing to use SCENE after that means you accept the updated Terms.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, including that the Service will be uninterrupted or error-free, or that you'll find a match.

16. Limitation of liability

To the fullest extent permitted by law, SCENE is not liable for indirect, incidental, special, consequential or punitive damages, or for any conduct of other members, online or offline. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and $100.

17. Disputes and arbitration

If you have a concern, contact us first at hello@datethescene.com and we'll try to resolve it informally within 60 days. If we can't, disputes will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, held in Los Angeles County or by video, except that either of us may bring an individual claim in small claims court. You and SCENE waive any right to a jury trial or to take part in a class action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

18. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

19. General

If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a term isn't a waiver. You may not transfer your account or these Terms; we may transfer them as part of a merger, acquisition or sale of assets. These Terms, our Privacy Policy and our Cancellation and Refund Policy are the whole agreement between you and SCENE about the Service.
